Does license allow reselling patches?

I've got a question regarding Magento v1.9 LTS.

We were working with MageOne, and it seems that they are essentially only copying your patches for a monthly fee of idk 39 Euro.

Is that aligning with the license in your repository? I don't think that they state this explicitly somewhere.
