Able to submit dates in past

For the autopublish / scheduled open date feature, as a partner I can submit a draft for approval with an open date in the past. However, the right error that the date must be in the future does show if I try to save the draft. We must be skipping validation there somehow. A partner should not be able to submit with an open date in the past.

What happens if the date passes and the admin approves it?
They get a modal and it publishes immediately
